These terms cover your use of the Refresca website. The site is currently a pre-launch page where you can join our waitlist. Please read this. By using the site, you agree to it.

1. Accepting these terms

By visiting this site or submitting your email to the waitlist, you agree to these terms. If you do not agree, please do not use the site. If you are using the site on behalf of someone else, you confirm you are allowed to accept these terms for them.

2. This is a pre-launch site

Refresca has not launched yet. Today, this site is informational and exists to collect waitlist signups. A few things follow from that:

• No product is sold here. There is no store, no checkout, and no order.
• Joining the waitlist is not an order and is not a guarantee that you will be able to buy anything.
• Any pricing, product details, ingredients, or availability you may see are not final and can change before launch.
• We may change, pause, or remove the site or the waitlist at any time.

3. Intellectual property

The Refresca name, the lowercase wordmark and logo, the look and feel of the site, and all text, images, and design are owned by Refresca or used with permission. They are protected by intellectual property laws. You may view the site for your own personal, non-commercial use. Please do not copy, reproduce, or use our name, logo, or content without our written permission.

4. Acceptable use

When you use the site, please do not:

• Submit false information or someone else's email without their permission.
• Attempt to break, overload, scrape, or gain unauthorized access to the site.
• Use the site for anything unlawful, harmful, or fraudulent.
• Interfere with how the site works for other people.

5. Email submissions and marketing consent

When you submit your email to the waitlist, you agree that we may contact you about the Refresca launch, founding-member offers, and related updates. You confirm the email is yours (or that you have permission to use it). You can unsubscribe at any time using the link in any email we send, or by emailing hola@refrescame.com. How we handle your email is described in our Privacy Policy.

6. Disclaimers

The site is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent allowed by law. We do not promise that the site will always be available, error-free, or secure, and we do not promise that any product, price, or timeline shown will be offered as described. Any reliance you place on the site is at your own risk.

7. Limitation of liability

To the fullest extent allowed by law, Refresca will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the site. Because this is a free, pre-launch informational site, our total liability to you for any claim relating to the site is limited to one hundred U.S. dollars (US $100).

8. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You agree that any dispute relating to these terms or the site will be handled in the state or federal courts located in California, and you consent to their jurisdiction.

9. Changes to these terms

We may update these terms as Refresca gets closer to launch. When we do, we will update the "Last updated" date above. If you keep using the site after a change, you accept the updated terms.
